What is this policy?

This Privacy Policy sets out the terms on which we collect, process and handle personal data which you provide to us while using or otherwise acceding the app known as "EQUA.LS" and/or the site at www.EQUA.LS (together the "Site") and the services provided from the Site ("Service"). The Site, together with all content on each, is owned or controlled by Equals Collective Limited, a company incorporated in England with its registered office at 35 Ballards Lane, London N3 1XW, UK ("we" or "our" or "Company").

What data will EQUA.LS collect from me?

To provide the Service, it is necessary for us to collect and process certain personal information ("Data"), including some or all of the following:

  • name, address, date of birth, gender, email addresses and mobile phone numbers;
  • IP addresses, device and web-browser details, operating system details, activities on the Site, personal preferences relating to the Site and Service;
  • billing and financial information such as credit/debit card numbers;
  • details of the locations from which you use the Service;
  • profile pictures uploaded by you;
  • social media handles and linked account information (e.g. Spotify, Instagram, TikTok, Snapchat);
  • messages and communications sent via the in-app messaging feature;
  • music listening history and preferences (where you connect a third-party music account such as Spotify);
  • geolocation data, including latitude and longitude coordinates (where you grant location permission);
  • device identifiers, device model, and operating system version;
  • push notification tokens and notification interaction data;
  • content you create, upload, or interact with on the platform (including tracks, grids, collaborations, and collectables);
  • participation data from quizzes, challenges, and gamification features;

You are responsible for ensuring that all personal information you provide to us is updated and correct at all times.

How will EQUA.LS use my data?

The Data will be stored together with any additional information you provide to us, and will be used to provide you with (and to improve) the Service. We may collect, store and process certain personal information to provide you with information and tools to allow you to use the Service, to perform marketing and research related activities, to supply other administrative services (e.g. setting up new accounts), to respond to enquiries and/or for other record-keeping purposes and to improve the Site and the Service.

From time to time we and/or our trusted partners may contact you with offers that may interest you or to inform you of other products and services, including without limitation our label and artist partners who may contact you by email with information and/or offers regarding new material, live dates, specific artist merchandise or other similar matters.

We use your profile picture and other submitted content to support age verification, identity verification, and content moderation checks. For these purposes, your profile picture and relevant personal information may be processed by artificial intelligence (AI) systems provided by our third-party AI service provider, OpenRouter. These AI systems may analyse images and text you submit to verify your identity, assess your age, and ensure content complies with our policies. Automated decisions made by these systems may result in content being flagged, removed, or your account being restricted, subject to human review where appropriate.

We may, from time to time, expand or reduce our business which may involve the transfer of certain divisions or assets of our company to other parties, and Data, where relevant, may be transferred to such third parties. Additionally, from time to time we may transfer Data obtained from Users located in the UK and/or the EU to locations outside the UK and/or the European Economic Area, some of which may have different data protection laws to those within the UK and/or the EEA, or no data protection laws. In all such cases, we transmit such information only to entities that comply with this policy and applicable law. All Data is processed by us in accordance with applicable data protection legislation and we will keep your personal information only for as long as is necessary.

Third-Party Services and Data Processors

To operate and improve the Service, we share your Data with the following categories of third-party service providers. Where these providers are located outside the UK/EEA, we ensure appropriate safeguards (such as Standard Contractual Clauses) are in place:

Analytics and Performance Monitoring: We use RudderStack (customer data platform), Amplitude (product analytics and session replay), Firebase Analytics, Datadog (error monitoring and performance), Statsig (feature testing), and AppsFlyer (mobile attribution) to understand how users interact with the Service, diagnose technical issues, and improve the user experience. These services collect usage data, device information, and interaction events. Amplitude Session Replay may visually record your interactions with the app (including screen content and touch events) for product improvement and debugging purposes.

Authentication Providers: You may sign in using Apple Sign-In, Google OAuth, or Spotify OAuth. When you do so, we receive certain profile information from these providers (such as your name, email address, and profile picture). Authentication tokens are stored securely to maintain your session.

Messaging Services: In-app messaging is provided by GetStream. Your message content, chat history, read receipts, and related metadata are transmitted to and processed by GetStream's servers.

Payment Processing: Payments are processed by Stripe (web), Apple (App Store), and Google (Google Play). Creator and supplier payouts are managed by Tipalti, which collects banking details and tax information from payees.

Music Platform Integrations: We integrate with Spotify, Apple Music, 7Digital, and MusicStory for music catalogue data, streaming, and artist metadata. If you connect your Spotify or Apple Music account, we may access your listening history and music preferences to personalise your experience.

Cloud Infrastructure and Communications: User-uploaded content (including profile pictures, audio, and artwork) is stored on Amazon Web Services (AWS). Transactional and marketing emails are sent via SendGrid. Video content is hosted by Mux. Event data may be routed through Google Cloud Pub/Sub.

AI and Content Moderation: User-submitted content (including profile pictures, text, and uploaded media) is processed by AI systems via OpenRouter for identity verification, age verification, and content moderation purposes.

Push Notifications: We use Firebase Cloud Messaging to deliver push notifications to your device. We collect and store your device push token for this purpose. Notifications may include messages, activity updates, and promotional content. You can manage your notification preferences in your account settings or through your device's system settings.

Personalisation and Recommendations

We use algorithmic recommendation systems to personalise the content shown to you within the Service. These systems analyse your listening behaviour, engagement patterns, location, and music preferences to suggest tracks, artists, and content we believe you will enjoy. You can influence these recommendations by adjusting your preferences within the app.

On-Device Data Storage

The EQUA.LS app stores certain data locally on your device, including authentication credentials (encrypted using your device's secure keychain or keystore), user preferences, cached content, and application state. This data remains on your device and can be cleared by uninstalling the app or using the app's reset function.

Social Sharing

The Service allows you to share content (such as tracks, artist profiles, and activity) to third-party social media platforms including Instagram, Snapchat, TikTok, WhatsApp, and Telegram. When you share content, certain information (such as your profile name and the shared content) may be transmitted to these platforms. Your use of these platforms is governed by their respective privacy policies.

What about links on the site and the app?

The Site and the App may each display links to certain third party websites or apps. We encourage you to read the individual privacy policies of those third party websites and/or apps before providing any of your personal information to them.

Cookies and Similar Technologies

We use cookies and similar technologies (including local storage on your device) to operate and improve the Service. On the website, cookies are small data files stored on your device. In the mobile app, equivalent technologies such as AsyncStorage and encrypted device storage serve similar purposes. These technologies are used for:

  • enabling us to recognise your device so that you don't have to give the same information to us several times;
  • recognising that you may already have given a username and/or password; and/or,
  • measuring how you are using the Service, to make the Service easier to use and to ensure sufficient capacity for quick delivery;
  • delivering analytics data to our analytics providers (see "Third-Party Services" above);
  • supporting feature flags and A/B testing to improve the Service;
  • storing authentication tokens securely on your device.

A "cookie" is a small amount of data sent from the server and stored on your computer's hard drive. Most web browsers are automatically set up to accept cookies, but you can set your browser to refuse cookies or ask your browser to show you where a cookie has been set up. Can I opt out?

Please note you have the right to request access to and rectification or erasure of Data or to object to or request the restriction of processing of your Data. If you are not interested in receiving email notices or advertisements from us, you should unsubscribe via your "Account Settings" on the Site (or by emailing us at [email protected] with "Unsubscribe" in the subject line). We reserve the rights in all cases to retain Data necessary to provide the Service and other legal reasons in full compliance with applicable Data Protection Law.

Will EQUA.LS change this policy?

We may change this Privacy Policy from time to time and such changes shall be effective from the date and time the revised Privacy Policy is posted on the Site. We encourage you to review our Privacy Policy on a regular basis so that you will be aware of any changes to it.
